Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client") and Fire Safe Technologies Inc ("Company"), a California corporation located at 1048 Bellevue Ave #3068, Santa Rosa, CA 95407 (CSLB License C-16 No. 1001438).

By accessing our website or engaging our services, you agree to be bound by these Terms.

2. Services

Fire Safe Technologies Inc provides fire protection contracting services in California, including:

• Design, installation, inspection and maintenance of fire sprinkler systems (NFPA 13, 13R, 13D)
• Fire suppression systems (clean agent, CO2, foam, wet chemical)
• Fire alarm system installation and testing (NFPA 72)
• Fire extinguisher sales, inspection, and recharging
• Backflow prevention device testing
• NFPA 25 inspection, testing, and maintenance
• Corrosion management and nitrogen inerting

Website inquiries do not constitute a binding service agreement. All services require a written and executed contract.

3. Quotes and Proposals

• Valid for 30 days from date of issuance unless otherwise stated
• Subject to site conditions and property access
• Changes to scope may result in price adjustments
• Not binding until a written contract is fully executed by both parties

4. Client Responsibilities

As a client, you agree to:

• Provide safe and timely property access for inspections and installations
• Disclose known hazards or existing fire system issues
• Ensure adequate water supply for the fire protection system
• Obtain any necessary permits from building owners or HOAs prior to our work
• Make payments per the agreed schedule

5. Payment Terms

• Invoices are due upon receipt unless otherwise agreed in writing
• Accounts past due 30 days may incur a 1.5% monthly finance charge
• Client is responsible for all collection costs including attorney's fees
• We accept check, ACH, and major credit cards

Pursuant to California Civil Code Section 3110, we reserve the right to file a mechanics lien for unpaid work.

6. Warranties

Workmanship: All installation work is warranted for one (1) year from completion, performed in compliance with NFPA standards and California Building Code.

Equipment: Equipment is covered by the manufacturer's warranty, passed through to the client. Warranties exclude damage from misuse, unauthorized modifications, or acts of God.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, FIRE SAFE TECHNOLOGIES INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. Our total liability shall not exceed the total amount paid for the specific services giving rise to the claim.

We carry general liability and workers' compensation insurance as required by California law. Certificates are available upon written request.

8. Compliance with Laws

All work is performed in compliance with NFPA standards, the California Building Code (CBC), California Fire Code (CFC), and local Authority Having Jurisdiction (AHJ) requirements. Clients are responsible for any pre-existing code violations.

9. Cancellation

Appointments require at least 24 hours written notice for cancellation. Less than 24 hours may result in a trip charge. Cancellation after project commencement may result in charges for work completed plus costs incurred.

10. Dispute Resolution

Disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Construction Industry Rules, in Sonoma County, California. The prevailing party shall recover reasonable attorney's fees and costs.

11. Governing Law

These Terms are governed by the laws of the State of California. The courts of Sonoma County shall have exclusive jurisdiction over disputes not subject to arbitration.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the revised Terms.
